(Puga Varela Fashion Concepts from now on), NIPC 515928844 with registered office at Av. Do Rosal, n° 5, 4780-589, Sequeiró, Santo Tirso, Portugal and is registered at the Commercial Registry of Lisbon by AP. 79/20200304 has the email address info@sirapuga.com and telephone +351 252321138. 

 

 

2. Customer Registration

To gain access to the complete content and all the tools and resources of the website, including the possibility to use purchases, or the customer to create an account with personal data, what are the items they use and used to identify purchases, used under the terms of the Privacy Policy. 

 

 

3. Rules for Use of the Site

As sales made through the online site www.sirapuga.com, are subject to the Terms and Conditions applicable in this document and pressure the buyer's acceptance. A minimum age of 18 is required to make purchases. Puga Varela Fashion Concepts reserves the right to change and / or modify the General Terms and Conditions of Sale without prior notice, being obliged to publish changes and / or alterations on the current website. The Client and / or User undertakes to use this site respecting and observing these Terms and Conditions, as well as current legislation, costumes and public order. Puga Varela Fashion Concepts may, in its sole discretion, block, restrict or prevent the access of any customer and / or user of a website, total or closed, without notice, whenever improper conduct is detected, without prejudice to administrative measures, extra-judicial and judicial judges deemed convenient. The user can remove any time from his account.

5. Product Warranty

As a fundamental consumer right, Puga Varela Fashion Concepts offers a two-year warranty, counting from the delivery, for its products, granting the buyer, in cases where it is legitimate, one of the following solutions: 

a) - Repair of the property; 

b) - Exchange for an equal good; 

c) - Exchange for a similar good in terms of characteristics and purpose, as long as agreed with the buyer; 

d) - Termination of the contract and consequent reimbursement if none of the previous options is possible. 

 

The exercise of the right to guarantee by the buyer will always take place through the submission of a complaint via e-mail and demonstration of the product defect through photos and / or videos. 

 

Puga Varela Fashion Concepts will analyse the article in question in order to confirm the effective right to guarantee, excluding all situations that prove to result, among others, from: 

a) - Abuse, intentional damage or negligent damage by the buyer; 

b) - Normal wear and tear; 

c) - Impossible to prove the defect indicated by the buyer; 

d) - All situations that are detected as attempted fraud. 

 

In cases where the guarantee is exercised, Puga Varela Fashion Concepts will try to resolve the situation within a maximum period of 30 days from the date on which the buyer activated the product warranty. 

The refund of any amount will be made by bank transfer. 

 

 

6. Stock

No responsibility can be attributed to Puga Varela Fashion Concepts For any temporary unavailability of one or more products. 

In case of purchase of a product not in stock due to failure to update the website, Puga Varela Fashion Concepts will contact the buyer with a view to the immediate solution of the problem, by refunding the amount paid, by replacing it or determining to wait for availability of product.

 

 

7. Returns 

If the buyer intends to return one or more products, he can do so within 14 days of receiving the order, provided that the products are intact, sealed, complete and in the original packaging, which must not be damaged, altered or scratched. 

To exercise his right of return, the buyer must contact Puga Varela Fashion Concepts, sending by email the order number and the reference of the product he intends to return. 

The return of incomplete, damaged or scratched products, as well as products without packaging, or products with signs of having been used are not accepted. 

The buyer must send the product to the following address: Av. Do Rosal, n.º 5, 4780-589, Sequeiró, Santo Tirso, Portugal. The refund will be made by bank transfer. 

 

 

8. Exchanges

Buyers wishing to make an exchange must first contact Puga Varela Fashion Concepts, specifying the order number and product description or reference. 

The buyer must send the product to the following address: Av. Do Rosal, n° 5, 4780-589, Sequeiró, Santo Tirso, Portugal. 

Important note: there is no place to exchange when the product presents, among others:

a) - Absence of defect (no evidence of damage pointed out by the buyer); 

b) - Evidence of inappropriate use of the product;

c) - Evidence of accidental damage; 

d) - Natural wear and tear due to use;

e) - Inadequate washing of the product;

f) - Altered product.

 

 

9. Payment

To purchase the products, the buyer must access his account and follow the instructions on the website. After choosing the products and the respective quantities, the buyer will be directed to the payment page, to calculate the freight and choose the payment method. This is the last moment for the buyer to identify and correct any mistakes made in the previous steps. 

Puga Varela Fashion Concepts will immediately send an email to the buyer indicating the order number, the products, the quantity requested and the price in Euros with the respective invoice.

 

Important note: Puga Varela Fashion Concepts does not store any login data from the buyer's Paypal account. 

 

 

10. Delivery Process 

Puga Varela Fashion Concepts will inform the buyer of the estimated delivery time for the products according to the place of delivery. 

Puga Varela Fashion Concepts will send an email with the Tracking Code number so that the buyer can follow up the postal flow of their orders via the Post Office / Carrier. 

Some exceptional situations can cause delays in the delivery of products, such as the indication of a wrong, incomplete or non-existent address or the occurrence of natural factors (rains, floods) or human factors (strikes, demonstrations, accidents), known as fortuitous events and force majeure. In these cases, the buyer should contact Puga Varela Fashion Concepts so that possible measures are taken at the Post Office / Carriers. 

Providing an incorrect or incomplete delivery address may result in your return to Puga Varela Fashion Concepts, resulting in additional shipping costs for the buyer if he requests a new delivery. 

The buyer can receive the order wherever he wishes, with the exception of post office boxes. 

Warning: it is not possible to choose a specific delivery time, as it will be conditioned by the post office / carrier's schedule. 

 

 

11. Shipping Costs

Shipping costs are automatically calculated by the system. 

If the reason for returning the order was the responsibility of Puga Varela Fashion Concepts the buyer will be reimbursed for the respective expenses.

12. Official Schedule

In the purchases made on the website, the Portugal local time must always be considered.

 

 

13. Intellectual, Property Rights

Intellectual Property shall be considered official, as well as that of all Users when accessing the website, certifying that they will respect the existence and extent of rights of third parties that are used, in any capacity, on the website or that become available on it. 

The brands and other distinctive signs on the website belong to their respective owners and are protected by patents and / or copyrights registered by the competent authorities. The content of the website, including the domain name, cannot be reproduced, distributed, sold, transferred or modified in any way, even if partially. 

The User who violates the prohibitions contained in the legislation on intellectual property and in these Terms and Conditions will be held responsible, civilly and criminally, for the infractions committed.

15. Forced Case and Force Majeure

Neither involved people will be liable to the other when the breach or untimely fulfilment of an obligation provided for in the Policies or in these Terms and Conditions is caused by acts of God or majeure force events and while the consequences have endured.

 

 

16. Principle of Respect for Customers and Users

Puga Varela Fashion Concepts has the principle of operating in virtual environments, respect for Customers and Users, always acting in compliance with the Consumer Protection Law and in compliance with the legislation applicable to the electronic commerce sector. 

 

 

17. Taxes

The prices on our website include VAT (Value Added Tax) of Portugal. 

VAT and other taxes are calculated according to the destination of the goods sold. When buying outside European Union it might be applied an additional tax or fee according to the Country destination Law.

The user should make note that international deliveries outside European Union might be inspected or open according to the Tax Authority of the Country.

 

 

18. Applicable Law 

These Terms and Conditions are governed by Portuguese law. In case of disagreement regarding the interpretation and application of these Terms and Conditions or of the relationships between the Client / User and Puga Varela Fashion Concepts, both parties, with express waiver of any other forum that may correspond to them, agree to the jurisdiction and exclusive jurisdiction of the Braga Courts.

 

 

19. Information about Conflict Resolution
